HEALTH LAW AND PATIENT SAFETY

2013 Conference

Patient Safety

Coimbra/Portugal
9-10-11 October 2013

The European Association of Health Law will hold its 4th Conference (2013) in Coimbra/Portugal, in collaboration with the Centre for Biomedical Law of the Faculty of Law of the University of Coimbra.

The overall theme will be: Patient Safety

“How familiar are you with the concept of patient safety? Hundreds of thousands of patients are harmed or die each year due to unsafe care, or get injured inadvertently when seeking health care.” (WHO).
What is the contribution that laws and jurists can give to ensure that access to healthcare is done in increasingly safer conditions? How can they contribute to ensure that the patient gets better and faster treatment?
What can laws and jurists do in order to turn errors into opportunities to build safer health systems?

The conference will consist of several keynote addresses from distinguished guests, and will also provide a wide range of presentations carried out in parallel sessions.
The organization invites experts to participate in these parallel sessions, which will be divided into three subthemes:

                  Preventive environment and measures
                  Reaction against malpractice/Patients Compensation
                  Learning with errors

Examples of presentation themes in parallel sessions on Preventive environment and measures:
                 
·       Fundamental Rights
·       Informed consent, Advance directives and Therapeutic information
·       Precautionary principle (Clinical research; off-label prescription; Generic drugs; Biobanks and governance; Genetics and MAP; Especially dangerous interventions/radiations)
·       Legal significance of the guidelines
·       Pharmacovigilance
·       Medical devices
·       Data protection
·       Protection of the most vulnerable           
o   the elderly
o   the mentally ill
o   children (conflicts with legal representatives; approval and refusal; intervention by protection commissions; paediatric trials)
o   cancer survivors (infertility prevention, social discrimination)
·       Electronic clinical file
·       Telemedicine
·       Advertising
·       Conflict of interests
·       Organization of services
·       Clinical governance
·       Sustainability and quality in NHSs (financing; priorities; activities licensing)
·       The Directive on the mutual recognition of professional qualifications and patient safety
·       Movement of professionals between states
·       Regulatory models of health-care professions
·       Training of healthcare staff
·       Recertification
·       Better technology, more safety?
·       Can the State enforce lifestyles?
·      Any other issues, without losing sight of the overall theme Patient Safety and of the sub-theme Preventive environment and measures.

·        The role of disciplinary law to improve patient safety
·        Legal actions and proof
·        Faute de Service (nosocomial infections/fatigue)
·        Producer’s liability (drugs/machinery/medical devices)
·        The no-blame/no-fault culture
·        The end of tort law in medical malpractice?
·        National systems of compensation of 'medical hazard'
·        Apologize laws
·        Alternative Dispute Resolution/Mediation and Arbitration
·        Risk management and adverse event notifications
·        The prohibition of self-incrimination and the notification systems
·        Health insurance and life insurance
·        Any other issues, without losing sight of the overall theme Patient Safety and the sub-themes Reaction against malpractice/Patients Compensation; Learning with errors.

Oral Presentations: 15-20 minutes for formal presentations and slides + 10 minutes for discussion  

Proposal Submission: Interested presenters should submit an abstract (250 words) summarizing the proposed presentation and a short bio (100 words) by email (eahlconference2013@fd.uc.pt and cdb@fd.uc.pt) or fax (+351 239 821 043) up to the 31st of May 2013
Submissions will be judged on relevance to the Conference’s general theme, clarity of thought, creativity and suitability to the Conference’s program

Notification of acceptance: up to 31th July 2013

Poster presentations: subjected to the overall theme of the Conference

Conference Registration: All presenters are expected to register online up to the 31st of August 2013
